The criteria for registering a brand varies from country to country. Generally, in order for a trade mark to be enforceable (or even registrable in some countries) it must be capable of distinguishing the goods or services of one company from those of another and must be capable of being represented graphically.

Registrations may be obtained for words, logos, labels, slogans, the shape of goods or their packaging, sounds and even smells. However it is more difficult to register a shape, sound or smell since it is more difficult to establish that such a mark has sufficient distinctive character for registration.
