Design Right in the Community

Design right arises in the shape or configuration of an article and is an unregistered right. In many countries, design right is established as soon as a design is recorded or an article is made to the design.

As with copyright, design right allows a party to prevent a third party from copying a work which is subject to design right.

We can advise whether or not a design attracts design right, whether such rights would be enforceable, and with regard to action which may be taken against infringing parties.
